Terms of Service

Effective date: July 28, 2026. Last updated: July 28, 2026.

OpenCreat is operated by Shenzhen Touchpoint Link Technology Co., Ltd. (深圳市触点连接科技有限公司). For questions about this policy, contact [email protected].

1. Agreement and eligibility

These Terms of Service form an agreement between you and Shenzhen Touchpoint Link Technology Co., Ltd. (深圳市触点连接科技有限公司) for your use of OpenCreat. By creating an account, using a workspace, or accessing the service, you agree to these Terms and the Privacy Policy and Acceptable Use Policy incorporated by reference.

You must be legally able to enter into this agreement and, if you use OpenCreat for an organization, have authority to bind that organization. The service is not intended for unlawful activities or use by people who cannot legally accept these Terms.

2. Service and workspace

OpenCreat provides a workspace for creator discovery, profile intelligence, creator records, CRM, campaigns, mailbox connections, conversations, AI-assisted drafting, activity tracking, analytics, team collaboration, and billing-related controls. Features, limits, providers, and availability may vary by plan, workspace settings, provider response, and applicable law.

We may modify, improve, discontinue, or restrict a feature when reasonably necessary for security, legal compliance, provider changes, reliability, or product development. We will not describe a feature as available on the public website when it is not part of the current service.

3. Accounts and members

You are responsible for the accuracy of account information, keeping credentials confidential, using strong authentication where available, and promptly removing members who no longer need access. You are also responsible for activity performed through your account or by invited members.

Workspace administrators control membership, roles, mailbox access, campaign access, and workspace settings. Do not invite a person or grant access unless you are authorized to do so and have provided any required notice.

4. User content and permissions

You retain your rights in campaign briefs, creator notes, imported records, message content, attachments, and other content you submit. You grant OpenCreat a limited, non-exclusive license to host, reproduce, transmit, process, and display that content only as needed to provide, secure, maintain, and improve the service.

You represent that you have the rights, permissions, notices, and lawful basis needed for the content and instructions you submit, including the right to connect a mailbox and contact recipients. Do not upload secrets, malware, unlawful content, or data unrelated to the workspace purpose.

5. Creator data and third-party services

Creator profiles, audience signals, posts, platform relationships, contact availability, and other enrichment data may be supplied by third-party platforms or providers. We do not guarantee that any particular creator will be found, that data will be complete or current, or that a creator will respond or accept an offer.

Your use of connected platforms, mailboxes, payment services, and other integrations is also subject to the applicable third-party terms. Provider outages, limits, policy changes, account visibility, or unavailable data may affect the service.

6. AI-assisted features

AI features may help interpret a search request, summarize creator information, draft outreach, prepare follow-ups, or suggest replies. AI output may be incomplete, inaccurate, biased, or inappropriate for a particular recipient and must be reviewed by a human before use.

OpenCreat does not make final legal, advertising, privacy, pricing, partnership, or brand-safety decisions for you. AI does not have authority to make an unapproved commercial promise or send a message without the approval and sending configuration required by the service.

7. Mailboxes and outreach

You authorize only the mailbox actions and sending modes that you configure. You are responsible for recipient permissions, message content, sender identity, opt-outs, applicable marketing and anti-spam rules, mailbox provider terms, and the consequences of sending.

We may delay, pause, reject, or limit delivery when a mailbox, provider, workspace, campaign, or message presents a security, compliance, abuse, or deliverability risk. A sending quota is a capacity boundary, not a guarantee of delivery or response.

8. Plans, billing, cancellation, and refunds

The price, billing cycle, included entitlements, usage limits, taxes, and applicable purchase terms are shown in the current checkout, order confirmation, or workspace billing page. Public pricing is informational until an order is accepted and confirmed.

Paid plans may renew according to the applicable order terms until cancelled through the available billing flow or by contacting support where required. Cancellation may stop future renewals but does not automatically reverse charges already incurred or preserve access after the paid period ends.

Refunds, credits, taxes, chargebacks, and payment disputes are handled according to the applicable order terms and law. Contact [email protected] promptly with the account, order, and reason for the request; do not send payment secrets or passwords.

9. Intellectual property

OpenCreat, its software, design, documentation, names, logos, and service materials are owned by or licensed to Shenzhen Touchpoint Link Technology Co., Ltd. These Terms do not transfer ownership to you. You may use the service only as permitted by these Terms and the applicable plan.

You may provide feedback, suggestions, or issue reports. We may use them without restriction or payment, provided that we do not identify you publicly as the source without permission.

10. Suspension and termination

We may suspend or terminate access, restrict sending, disconnect an integration, remove content, or require remediation when necessary for security, non-payment, abuse prevention, legal compliance, provider rules, or a material breach of these Terms.

You may stop using the service and request account handling through support. On termination, your right to access the service ends, subject to any transition or retention period required by the order terms, law, security, or dispute handling. Provisions that should continue by their nature remain effective.

11. Disclaimers and liability

The service is provided on an as-available basis. To the maximum extent permitted by law, we do not warrant uninterrupted operation, complete or current creator data, a particular campaign result, delivery rate, reply rate, conversion, or business outcome.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from your use of the service or third-party services. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity and governing law

To the extent permitted by law, you agree to defend and hold harmless Shenzhen Touchpoint Link Technology Co., Ltd. and its personnel from claims, losses, liabilities, and reasonable costs arising from your unlawful use, user content, mailbox activity, outreach, breach of these Terms, or violation of another person’s rights.

These Terms are governed by the laws of the People's Republic of China. Subject to mandatory law, disputes relating to these Terms or the service shall be submitted to a court with jurisdiction in Shenzhen, Guangdong, China.

13. Changes and contact

We may update these Terms when the service, providers, business arrangements, or applicable law changes. We will publish the updated version and date on this page. Continued use after the effective date means you accept the updated Terms, unless applicable law requires another form of consent.

For questions about these Terms, contact [email protected].
